with Elite-Gourmet.com will be governed exclusively by these General Terms and Conditions.
Prices, Products and Availability
We guarantee that the prices displayed during checkout will be the price paid for
each item regardless if the sale or special price expires before the order is shipped.
In other words, you will be charged only the price noted during checkout even if
the item goes off sale while waiting to be shipped. Be aware that any sale or special
pricing prior to checkout is only applicable during the period of the sale or special
pricing, regardless of whether the item is in the shopping cart or wish list.
Our cheeses and gourmet products are natural products and may vary slightly in appearance,
color or shape from the images displayed on the website. We make every effort to
ensure that our products are fresh and in the proper physical condition for shipment.
Please understand that many of our cheeses are cut from much larger natural wheels
or pieces and some of the product images displayed on the website are of the wheels
or larger pieces and are used only to better display the cheese. Products are of
limited availability and often supplied to us in irregular quantities and deliveries.
Despite our best efforts, occasionally some products will not be available between
the placing of your order and the expected ship date. We will contact you by email
prior to shipment if this occurs, and discuss what alternative solutions are possible.
If we are unable to contact you prior to shipment to discuss an alternative solution,
we will ship the remaining order less the missing item and refund the cost of the
missing item and any decreased shipping charges and or handling fees.
We reserve the right to refuse any order or to refuse to ship to any country or
to refuse to accept payments from any Customer at our discretion.
We want you to be pleased with our products and our service. We guarantee that your
products will be of good quality and in good physical condition when shipped. Any
item(s) that you deem unsatisfactory will be refunded in the form of a Elite-Gourmet.com
Gift Certificate limited to the cost of the item(s) deemed unsatisfactory provided
that you inform us of the problem within two (2) business days of having received
your order. We will not ask you to return the goods to us in order to claim a refund.
Shipping and or handling costs will not be refunded under any case.
Of course we hope that you are aware that tastes, aromas, and textures are subjective
and obviously not everyone has the same tastes and perceptions. We make every effort
to describe our products and services in terms that are understandable and hope
that you understand that just because an item does not agree with your tastes or
expectations do not mean that it is defective or not of good quality. In other words,
please don’t ask us for a refund just because you did not like the taste, texture
or aroma of a particular item. We have a very positive and customer oriented return
policy when compared to most in our industry and we reserve the right to become
more strict if people begin to take advantage of our trust.
Shipping, Customs and Taxes
We utilize internationally recognized couriers for most shipments. The choice of
shipment speed is yours, and the shipping costs are calculated not by Elite-Gourmet.com
but by the respective couriers. Couriers deliver express deliveries during the working
week, Monday through Friday, excluding applicable holidays and weekends. Home deliveries
are Tuesday through Saturday, excluding applicable holidays. If you desire express
Saturday delivery within the United States please contact us for the extra costs
that the carrier will charge for Saturday delivery.
Any damage to the order while in transit is the responsibility of the courier and
any claim for damage must be filed with the courier per the couriers’ standard terms
and conditions. Elite-Gourmet.com will not be liable for damages or loss during transit.
If the Customer is not present to receive the order when delivered by the courier,
it is the Customer’s sole responsibility to make arrangements with the courier to
reschedule the delivery. Elite-Gourmet.com will not be liable for any loss, damage
or deterioration of the products that may occur due to a delayed or rescheduled

Invalidity - Force Majeure - Applicable law - Competent Courts
If any one of the clauses of these General Terms and Conditions are, for whatever
reason, declared invalid or invalidated for any reason, this will not affect the
application or the validity of the other clauses. The clause declared invalid, or

the parties shall be brought only before the competent court in the United States.
